中文摘要 在当前的教师分类问责导向下,按公办与民办或者按教育阶段分类,已经无法概括教师法律责任的分化。实际上,教师法律责任呈现内部与外部的双轨制特征。内部为主、外部为辅的教师法律责任双轨制,有悖于事业单位改革方向,忽视了平等对待原则,不符合我国基本问责制度,也割裂了教师职业共同体。因此,内部法律责任应进行外部化整合,以行政处罚代替处分与其他处理作为追责方式,更有利于保障教师权利。具体而言,应当用《行政处罚法》中规定的处罚种类代替《教师法(修订草案)(征求意见稿)》第48条、第52条中的处分与处理方式,形成以行政处罚为主的教师法律责任差序格局。
英文摘要 Under the current orientation of teachers' classified accountability, it is no longer possible to generalize the differentiation of teachers' legal responsibilities according to public and private or education stages. In fact, teachers' legal responsibility presents a dual-track system of internal and external characteristics. The dual-track system of teachers' legal responsibility, which is internally based and externally supplemented, goes against the reform direction of public institutions, ignores the principle of equal treatment, does not conform to our country's basic accountability system, and splits the professional community of teachers. Therefore, internal legal responsibilities should be externalized and integrated, and the use of administrative punishments instead of sanctions and other treatments as a method of accountability is more conducive to protecting the rights of teachers. Specifically, the penalties specified in the Administrative Punishment Law should be used to replace the sanctions and handling methods in Articles 48 and 52 of the Teachers Law (Revised Draft) (Draft for Solicitation of Comments), so as to form a pattern of sequential difference for teachers' legal liability focusing on administrative punishments.
