中文摘要 在我国的教育法规体系中,少年宫教师作为“其他教育机构”教师应当与“各级各类学校”教师具有相同的法律地位。然而,实际情况是这些法规普遍忽视了少年宫教师的特殊性,少年宫教师与这些法规相“距”甚远,导致其处于法有据而无可依的困境。少年宫教师的双重身份属性是其游移于法律边缘的表层原因,对不同类型教育和教师之间的差异缺乏关注则是少年宫教师游移于法律边缘的深层原因。为此,建议从法律修订和理论研究两条路径改善少年宫教师的边缘化处境。
英文摘要 In China’s regulations and laws of education, teachers of the Children’s Palace should have had the same legal status as teachers of “other educational institutions” and teachers of “all levels of schools”. However, there is little concern that teachers of Children,s Palaces are different. For one thing, these regulations and laws are not suitable to protect them. For another thing, such kind of teachers will be under little control of the current legal system. The dual identity attribute of Children’s Palace teachers is the surface reason for the phenomena. And paying little attention to the varieties of educations and teachers is the root reason why Children’s Palace teachers’ current legal status. To conclude this paper proposes to improve the legal status of teachers of Children’s Palace, in terms of legal revision and theoretical research.
