中文摘要 家庭教育作为推进教育现代化过程中不可或缺的实践活动,其地位和作用愈加受到国家和社会的广泛关注。制定家庭教育法是促进家庭教育和谐稳定发展的必然选择。家庭教育权作为父母天然具有的教育权,其自然性、基础性、复合性、选择性、边界性的法律属性决定了家庭教育立法必须以确认父母的家庭教育权为逻辑起点。家庭教育立法应秉持实现儿童权益最大化的宗旨,将维护儿童生存权、发展权和自由权作为家庭教育立法的首要方向、核心精神和价值基准。当然,家庭教育法所涉及的内容比较广泛、包罗万象,但家庭教育立法中厘清家庭教育法律关系主体的权利、建构家庭教育权有效行使的制度保障体系、明晰家庭教育法律关系主体的基本职责应是其核心内容,意图达致保障儿童健康成长和家庭教育权有效行使的根本目的。
英文摘要 Family education, as one of the indispensable pillars of education in the process of promoting education modernization, has attracted more and more attention from the state and society. Enacting family education law is an inevitable choice to promote the harmonious and stable development of family education. The right of family education as a natural right of parents, its natural, basic, compound, selective and boundary legal attributes determine that family education legislation must start with the confirmation of parents' right to family education. Family education legislation should uphold the purpose of maximizing children’s rights and interests, and safeguarding children’s right to subsistence, development and freedom as the primary direction, core spirit and value benchmark of family education legislation. Of course, the content of the family education law is extensive and comprehensive, but the basic duties of family education legislation to clarify the rights of the subject of legal relationship in family education, to construct an institutional guarantee system for the effective exercise of the family education right, and to clarify the basic responsibilities of the subject of legal relationship in family education should be its core content, so as to achieve the fundamental purpose of ensuring the healthy growth of children and the effective exercise of the right of family education.
