中文摘要 当前我国中小学存在多种用人方式并相应形成多种法律关系,教师身份呈现多元性特征。各类编外用人方式较普遍存在管理规范性欠缺现象,带来诸多法律风险和管理问题。教师待遇偏低、编制紧缺且动态调整滞后导致的编内教师供需失衡是形成以上问题的深层原因。在不断优化教师工资待遇和编制等政策制度的同时,应大力深化中小学人事制度改革,赋予教育部门在教师人事制度与管理中的决策权和统筹权,统筹有效运用多种用人方式,建立健全岗位管理制度和基于岗位的人事法律关系,同岗同酬,切实保障编外教师权益。
英文摘要 There are many ways of employing people in primary and secondary schools in China and many legal relationships have been formed. Teachers’ identity is characterized by pluralism. There is a widespread lack of normative management in all kinds of non-staff employment, which brings many legal risks and management problems. The imbalance between supply and demand of teachers caused by the low salary, the shortage of edition and the lag of dynamic adjustment is the deep reason for the above problems. In the process of optimizing the policy of teachers’ salary, we should deepen the reform of personnel system in primary and secondary schools, determine the decision-making power and overall planning power of education departments in the personnel system and management of teachers, make overall and effective use of various ways of employment, establish and improve the post management system and the legal relationship of post-based personnel. Equal pay for equal posts, and earnestly safeguard the rights and interests of non-staff teachers.
