教育治理体系和治理能力现代化是教育现代化的必然要求，也是实现国家治理现代化的重要内容。但目前存在现实困境：教育立法尚不能满足教育治理及其制度创新的需求，难以给教育治理现代化提供必要的保障；政府及其职能部门作为教育治理者的角色转换尚未完成，教育领域多元主体之间的互动、合作机制缺乏；教育治理的价值目标与现实有较大的差距，公民有序参与教育治理的能力和动力不足。应从以下方面进行推进：构建完备的教育法律体系，大力提高教育法治化水平；以教育行政管理的改革和创新为关键，提升政府教育管理服务水平；强化学校作为公共教育治理的重要主体地位，提高学校自主治理能力；确立多元主体在教育治理中的地位和权利，推动社会参与教育治理常态化。

| 英文摘要 |
Modernization of educational governance system and governance capability are the inevitable requirements of educational modernization, also the important components of the modernization of national governance. However, there are realistic difficulties in educational governance system and capability. Educational legislation would not achieve the needs of institutional innovation and the guarantee of modernization. The role of the government as administrator has not changed completely. In the education field, there is a lack of multi-subject interaction mechanism. The value and goal have not achieved, and the level of public participation is low. Improvements should be forced in the following areas: Strengthen the system of educational legislation, improving the rules of law in education. Reform of educational administration is the key to raise government services. Give prominence to the school as an important subject of public education governance, improving the ability of school self-governance. Establish the rights and positions of the subjects in educational governance, promoting social participation in the normalization of education governance.
