中文摘要 为更全面了解《教师法》修订研究中教师法律身份的研究情况,必须收集关于教师法律身份的《教师法》修订研究文献并对之进行系统分析。目前学术界对教师法律身份的界定有六种最典型的观点:公务员说、教育公务员说、国家工作人员说、公务雇员说、特殊劳动者说和雇员说。研究发现,《教师法》修订研究中教师法律身份界定依据主要表现在三方面:教师工作所处的学校和学段特征,教师职业的公务性和专业自主性程度,教师队伍的建设和管理的现实需求。
英文摘要 In order to have a more comprehensive understanding of the research on teachers’ legal identity in the revision of the Teachers’ Law, it is necessary to collect and systematically analyze the literature on the revision of the Teachers’ Law concerning teachers’ legal identity. At present, there are six most typical viewpoints on the definition of teachers’ legal identity in academic circles: civil servant theory, education civil servant theory, state functionary theory, civil servant theory, special worker theory and employee theory. The research finds that the definition of teachers’ legal identity in the study of teacher’s law is mainly manifested in three aspects: the characteristics of teachers and schools, the degree of professionality and autonomy of teachers, the practical needs of the construction and management of teachers.
