中文摘要 依据《行政许可法》,高等教育行政管理与体制运作应建立在法律的基础上,通过立法等手段,规范大学内部人事管理制度改革。这就要求一方面要建立、规范教育行政部门和公职人员的相关法规,使各级政府教育行政部门在管理上有法可依,另一方面通过立法等手段确立大学管理、运营制度、建立办事高效、运转协调、行为规范的大学内部人事管理制度。本论文从法律的角度,对近年来我国大学教师聘任制实施的法律基础、改革中存在的问题以及对策与思路做一探析,对于进一歩深化大学教师聘任制改革,具有重要的现实意义。
英文摘要 Based on the Administrative Licensing Law, the operation of higher education management system should be established legally. The system of the personnel management in universities should be standardized by the legislation means. On the one hand, the related laws and regulations of the administration and the public officials should be established and standardized, so that there are laws in regulation that the governments at all levels and the education sectors can go by. On the other hand, the management and the operating system in universities should be established by the means of legislation, the system of the personnel management in universities which is efficient, coordinating and standardizing should be established too. The paper analyzes the problems and supplies some countermeasures in the law basis of the implementation of the appointment and the reform in universities. It owns import reality meaning in the future advancement in the reform of the appointment system of university teachers.
