上海的民办普通高等学校经过16年的发展建设，已经成为上海高等教育的重要组成部分。在快速发展的同时，也出现了一些负面的现象，既有民办高校自身办学行为不规范造成的问题，也有政策法规滞后造成的问题。据此，本文对上海市民办高等教育立法提出若干建议。

| 英文摘要 |
After sixteen years’ development, private higher education has become an important part of higher education in Shanghai. Notwithstanding its fast development, some negative phenomena have also occurred, which are not only the result of irregularities of school running in private higher education institutions, but also the result of the relevant policies and regulations lag. Accordingly, this article puts forward several suggestions on the legalization of private higher education in Shanghai.
