受教育权的国际标准由多项具有不同法律效力的国际文件共同确立。受教育权国际标准的框架由教育的目的、教育的受益权、教育的自由权、不歧视与制度保障五个维度,初等教育、中等教育、职业技术教育、高等教育与基础教育五个层次共同构成。其中有些标准要求国家立即予以实现,有些标准允许国家根据经济社会发展水平渐进实现。

英文摘要 |
The right to education and its international standards are enunciated in numerous international instruments. International standards concerning the right to education can be divided into five parts and five levels. The five parts are:aims of education, the right to receive an education, the right to educational freedom, non─discrimination, and fulfilling system. The five levels are :primary education , secondary education, technical and vocational education, higher education, and fundamental education. In terms of the timing to meet these standards, certain standards are “minimum core obligation” and require the states for immediate fulfillment, while other standards are conditional to the social and economic development for immediate fulfillment, while other standards are conditional to the social and economic development levels of the states in question.
