教育选择权是一项重要的人权。义务教育是根据法律规定，适龄儿童和青少年都必须接受的国民教育，教育公平是社会公平与和谐的基本要素。父母及其子女教育选择权的行使对教育公平的实现可能带来双重影响。本文主张在法律上确认教育选择权，在实践中引导和规范父母及其子女教育选择权的行使，以促进教育公平的实现。

| 英文摘要 |
Educational option is one of the important human rights. Compulsory education is national education that school-age children and adolescents have to accept in accordance with legal provisions. Educational fairness is the basic elements of the justice and harmonious of society. Parents and children's educational option can bring dual influences to educational fairness. This paper claims to confirm educational option in legal, guide and regulate the exercise of the parents and their children's educational option in the practice, so as to promote the realization of educational fairness.
